Important Information Regarding Court Documents and HIPAA:
Court Order -
A healthcare provider may share information concerning your health care plan by means of a court order, but the information must be limited to what is described in the court order
Subpoena -
A subpoena is different from a court order.
A HIPAA-covered provider or plan can disclose information only if the subpoena abides by the Privacy Rule. Before, there should be proof of reasonable efforts to:
- Notify the person who is the subject of the information about the request to give them an opportunity to object.
- Attempt a protective order for the information from the court.

Serving an individual at a government facility
If it is a personal matter involving an employee of the Health and Human Services, they must be personally served. Serving a subject personally at this location can be extremely difficult if the subject to be served is unwilling to receive. Security will stop us from entering and must know the reason for service. This, sadly, will notify the subject of our attempt to locate them and may cause them to hide or evade service altogether.
