How to Serve Process on Health and Human Services (HHS) and Where - POST COVID-19

Can you serve Health and Human Services by certified mail? YES! Same Day Process can assist with serving HHS by certified mail and provide an affidavit of service accordingly. Just click on “Send A Job” at the top of the screen, then click on “Service of Process.”

Same Day Process can certify mail to any government agencies and/or companies that are refusing to accept in-hand service and track the certified mailing. We will place the certified mailing tracking number in the affidavit and attach the certified return mail slip to the affidavit. We also scan the certified mailing slip and completed affidavit into our secure database. We store this information for your convenience so that you can access it when needed.

We are constantly watching government and corporate websites and still attempting in-hand service to verify current procedures when requested. We are happy to attempt in-hand, and then certify mail if the in-hand service fails. We cannot guarantee that the government provided links or corporate sites are current and they may accept in-hand service at any time without notice.

A healthcare provider may share information concerning your health care plan by means of a court order, but the information must be limited to what is described in the court order

Subpoena -

A subpoena is different from a court order.

A HIPAA-covered provider or plan can disclose information only if the subpoena abides by the Privacy Rule. Before, there should be proof of reasonable efforts to:

  1. Notify the person who is the subject of the information about the request to give them an opportunity to object.
  2. Attempt a protective order for the information from the court.

Serving an individual at a government facility

If it is a personal matter involving an employee of the Health and Human Services, they must be personally served. Serving a subject personally at this location can be extremely difficult if the subject to be served is unwilling to receive. Security will stop us from entering and must know the reason for service. This, sadly, will notify the subject of our attempt to locate them and may cause them to hide or evade service altogether.
