The Most Common Types of Affidavits

An Affidavit is a written testimony given under oath. Affidavits are only valid when given freely, without any coercion. To provide a legal affidavit, an individual needs to be of sound mind (lucid) and typical of legal age (over 18).

The Most Common Types of Affidavits

Affidavit of Residence

Establishing residency can be necessary for school placement, jobs, insurance, loans, taxes, and other services. This type of affidavit is a sworn account of where an individual, couple, or family live.

Affidavit of Heirship

This document will verify the recent death of an immediate family member. The family member will prepare the affidavit to ensure the correct distribution of assets. There must be descendants left behind who have been listed on the document. Having this type of affidavit is common when an individual did not leave a will.

Affidavit of Marriage

Most couples use a certificate of marriage to prove their union officially. If they cannot locate their certificate, the couple may create an affidavit to declare a legal marriage. Visas and specific financial arrangements may require proof of marriage.

Identity Theft Affidavit

People use this type of affidavit when their identity has been stolen, either online or in any other situation. Credit card companies and other services may require verification that someone stole your identity. This affidavit provides sworn testimony that your identity has unauthorized use.

Affidavit of Service

Establishing an official delivery of service is essential for some businesses and legal proceedings. This type of affidavit will verify the delivery of service and will consider any necessary paperwork.
